Drive Discovery - Drive Discovery comprises three main program areas: Torch Bin - our recycle bin manager; Discovery Recovery – file recovery / eradication software; and Drive Privateer – our drive clean-up software. Taken together, our software gives users unrivalled control over their file contents.

Use Discovery Recovery to list all historically deleted but potentially recoverable files and data. Users have the discretion to selectively erase otherwise recoverable files to US government standards, as well as the ability to recover files that have been lost or deleted – it even has a built in deleted file and image viewer.

In addition, Torch Bin radically extends recycle-bin functionality with its flexible integrated manager. Users can opt to wipe all files automatically when they’re sent for deletion, or alternatively choose to selectively eradicate (or recover) specified files. Again, there is a deleted file and image viewer, fast and convenient.

For those who prefer their drives regularly cleaned of all residual data traces, Drive Privateer is our fast and powerful hard disk clean-up utility. Privateer will erase all previously deleted (but otherwise recoverable) data. Uniquely, it can also clean underneath existing files, leaving them safe, intact and defragmented! A built in multi-drive capable scheduler allows overnight cleaning with auto-shutdown.

Drive Discovery recognizes and responds to everyone’s need to control what’s on their computers. This easy-to-use product offers a level of secure control over drive contents not previously available. Even after expiry of the 30 day trial, our recycle-bin manager will remain completely functional as a ‘thank-you’ for taking the time to download the software.

PLEASE READ THIS LICENSE AGREEMENT CAREFULLY BEFORE COMMENCING YOUR INSTALLATION OF DRIVE DISCOVERY. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE NOT AUTHORISED TO INSTALL THE PRODUCT AND YOU MUST CEASE THE INSTALLATION ROUTINE FORTHWITH.

TRIAL VERSION

The software product Drive Discovery is supplied as a time limited ‘free trial‘ authorised product within the format of the installation package provided. The unregistered version of Drive Discovery may be freely distributed and installed, provided that the distribution package supplied by Notso Software Ltd (the Copyright Holders of Drive Discovery) remains in its original state and is not added to or otherwise modified in any form; with the following exceptions:

a. The above license does not authorise the distribution of any of the separate program elements of Drive Discovery contained within the installation package. Copyright and contractual rights which apply to the product as a whole are also exercised over its individual constituent elements.

b. The unregistered trial version of Drive Discovery may not be distributed in an embedded manner from within any other software package; nor may it be distributed, commercially or otherwise within any other distributive product or mechanism such as magazine disks, without written permission from Notso Software Ltd or its authorised agents.

c. Any attempt by users to circumvent the time-limited restrictions imposed and agreed in accordance with this contract, or to assist others to do so, shall constitute an ‘irrevocable’ breach of this contract. Notso Software Ltd, reserves the right to take whatever steps are necessary to disable Drive Discovery on any given personal computer system where we determine this has arisen. Additionally, Notso Software Ltd reserves all rights with regard to copyright and damages arising from any contractual breach, subject to the jurisdiction specified in this contract.

ADDITIONAL RESTRICTIONS RELATING TO THE DISTRIBUTIVE PRODUCT

The inclusion of any methodology, code designed to crack the software license protocols or passwords designed to deliver effective time-unlimited usage to unauthorised and unlicensed persons or companies or institutions, may not be included within the authorised distribution package or alongside it, nor may be supplied or appended alongside any part of the installed product or elements thereof, in a manner designed to circumvent the obligations of users to license the product in accordance with this contract.

FULL LICENSED VERSION

The full licensed version is not time limited in any way and, by purchasing a license, users are entitled to;

a. use Drive Discovery beyond the ‘time-limited’ trial period. Only single usage licenses are available for Drive Discovery. A single usage license entitles the purchaser to enable the full licensed software on one computer only at any one time, if for personal use, OR the license purchaser may elect to install the software any one workstation where there may be multiple users.

b. freely transfer the product from one computer system to another provided only one fully enabled licensed version per license purchased in enabled on the purchasers computer systems at any given time.

c. use the software on any network. Users should note that the time limited version will be available to use from any network drive on any computer connected to the network, but that a license will be necessary to enable the software to remain fully functional beyond the time limited trial period.

Rights under this license are fully transferable where the installed and licensed software installation of Drive Discovery is transferred with any given computer system on which the authorised installation resides. However, the user may NOT distribute any full version of the software together with appropriate license codes outside of the legal control of the original license holder. Users who effect such transfer will have their license immediately revoked and will be held liable for any damages or losses arising to Notso Software Ltd.

Possession of a copy of Drive Discovery, licensed or otherwise, does not confer rights to emulate, resell, copy, modify, decompile, disassemble, or otherwise reverse engineer Drive Discovery. Any such unauthorised use shall result in immediate revocation of this license and may result in criminal and/or civil prosecution.

Users should note that distribution of the full licensed version of Drive Discovery outside of the terms permitted under this contract, or otherwise using or distributing any unauthorised versions of Drive Discovery enabled in any way designed to circumvent license obligations arising under this contract, is potentially a serious criminal offence and may give rise to prosecution under appropriate U.S., U.K., E.C., and / or international copyright laws and treaties, and WILL be reported to the appropriate regulatory and investigative authorities.

Drive Discovery (R)

All rights, copyright and constituent code contained within the software product Drive Discovery is owned exclusively by Notso Software Ltd, a ‘company’ constituted and registered in the United Kingdom. All rights not expressly granted within this contract are hereby retained.

DISCLAIMER OF WARRANTY

Drive Discovery is distributed "as is". No warranty of any kind is expressed or implied, either in use, performance or merchantability. Due to the inability of Notso Software to control disparate environments which may be subject to installation, no warranty of fitness or suitability for a user determined purpose is offered.

Users are advised that use of Drive Discovery is ’at own risk’. Neither Notso Software, nor any agent of the company can be held liable for any loss of data, damages arising whether direct or indirect for any loss whatsoever while using this software.

Users are advised that the powerful data eradication procedures and protocols can irrevocably destroy valuable data if the software is used improperly. Users are therefore advised to make themselves competently familiar with all user documentation, FAQs and help files which accompany this product, before using Drive Discovery. We further strenuously recommend that Drive Discovery be tested on non-critical data stored on non-critical systems before making a determination as to product suitability for any purpose intended by the user. The liability of Notso Software Ltd shall extend only to, and be limited exclusively to, a refund of the license fee where such a fee has been paid. Users must assume the entire risk of using Drive Discovery on their designated systems and agreeing to this contract expressly endorses acceptance of this contractual provision by the user.

LEGAL JURISDICTION

It is expressly accepted by all parties to this contract that this contractual agreement be governed by the laws of the United Kingdom of Great Britain and Northern Ireland. The jurisdiction of UK law is hereby acknowledged and accepted as irrevocably primary. All users of this software agree to be subject to UK law and jurisdiction, and EC law and regulation where appropriate that such legislation or regulation supercedes that of the UK, subject to the governance of the UK regulatory authorities.

In the event of a dispute arising from use of Drive Discovery, irrespective of the relationship of such dispute to this Software Agreement, Contract undertaken hereby or Warranty Disclaimer; the user expressly undertakes to submit to the binding arbitration of whichever official UK arbitration agency is deemed at the time of lodging notification of such dispute with Notso Software Ltd to have demonstrable jurisprudence in resolving such contractual matters.

In the event that parties to any dispute so arising are unable to agree an appropriate agency for arbitration, it is hereby agreed that the form of arbitration which shall replace the previously designated agency shall be as follows. That arbitration to resolve the dispute shall be conducted before a panel of not less than three arbitrators. The parties hereto shall each have the right to select one of the three arbitrators, and the two arbitrators so chosen shall select the third arbitrator. The parties hereby waive any and all objection to jurisdiction and venue, the right to have their disputes adjudicated in a court of competent jurisdiction in any nation of the world, and the right to a jury trial, where applicable.

ACCEPTANCE OF TERMS

Installing and using Drive Discovery signifies acceptance of the terms and conditions contained herein and applicably to the licensed terms of use where appropriate. Additionally, by accepting this agreement, you expressly authorise Notso Software Ltd and / or its agents, to contact you via email where we deem appropriate. IF YOU DO NOT AGREE TO THE ABOVE TERMS AND CONDITIONS IN THEIR TOTALITY, NOTSO SOFTWARE LTD WILL NOT ENTER INTO A CONTRACT WITH YOU, AUTHORISING YOU TO INSTALL AND USE DRIVE DISCOVERY, IN WHICH CASE YOU MUST TERMINATE YOUR INSTALLATION NOW AND DELETE THE PRODUCT DISTRIBUTION SOFTWARE FROM YOUR COMPUTER SYSTEM.
